So the question is how do you sell weed without a license?
Before we continue I must tell you that marijuana laws change almost on a daily basis. That makes it very important to understand the possible consequences of your actions before you consider attempting what I am about to tell you. Read local laws or talk to a legal expert near you.
Marijuana ‘Gifting’ Loophole
The problem with selling marijuana legally is you have to pay taxes and legal fees, however, if you don’t operate a dispensary you won’t have to pay the ‘man’. The thing is, under the “gifting” provision, you are allowed to exchange or gift small amounts of weed to another adult. Let me make it clear, if you are under 21, this provision doesn’t protect you, meaning if you are caught selling or in possession, you will be in deep shit.
The question that’s on your mind right now is how do I profit from that loophole?
It’s really easy, let’s say you have sandwich bags in your home. If you pack them with less than an ounce of weed you can sell the bag and claim that the weed inside it is a free gift. Alternatively, you can sell t-shirts, electronics or anything else (at inflated prices) and offer weed as a gift. Think of it as one of those promos you see every day “buy 1 get 1 free” or “buy this and get that free”.
How To Avoid Fraud Charges
Let’s assume that you are selling t-shirts and handing out marijuana as gifts.
At Wal-Mart, a t-shirt costs anywhere from $12 to $19 or more. It is not unheard of to buy or sell $50 or $100 t-shirts, however, if you sell a t-shirt at let’s say $300 or $500, you may face fraud charges.
The point is, keep the prices within reasonable limits.
Don’t Advertise The Traditional Way
Just like tobacco, the law doesn’t allow you to advertise marijuana and its products to the public. On top of that, Google and Facebook don’t allow marijuana ads, so the question is how to advertise?
The first and the best option you have is word of mouth, the trick is to get people talking about your service. You can spread the word through social media or apps such as telegram. The thing is according to marketers, 92% of consumers trust recommendations from family and friends. That means that if done right, word of mouth advertising is the most effective tool you have at your disposal. What you have to do is give customers something to talk about.
As a species, we all like to be treated fairly. The trick is to create an excellent experience for all your customers. For example, if you are selling t-shirts, why not print something on it that draws attention to your business?
I have never heard of a person getting arrested for walking around with a t-shirt or mug that has marijuana printed on it, have you? If you want people to wear that t-shirt or use that mug, it has to be unique and attractive i.e. give them value for money.
The idea is to make the product you are selling a gateway to your business. For example, if you are selling juice, come up with a name and design that not only promotes the juice but also the product you are really selling. You want people to look at your t-shirts or mugs and go “where did you get that?”
Keep The Amount Below Legal Limits
Depending on where you are, the legal amount of weed you can hand out as a gift varies. To be safe, keep the amount below an ounce or check local laws. The problem with violating the laws set by ‘the man’ is you might find yourself behind bars or you may have to pay heavy fines for your actions.
Generally, to avoid problems with the law you should:
- Be 21+ years
- Cultivate up to 6 plants or the legal amount specified in your state.
- If there is more than one adult you may be allowed to grow up to 12 plants depending on state law.
- Transfer up to an ounce of weed to another adult, without exchange of money and without being advertised or promoted to the public.
Note the part where you are not allowed to give or receive money for marijuana gifts. During an exchange, you must make it clear that you are not receiving or paying money for marijuana. The money is for the t-shirt, orange juice or whatever product you or someone else decides to sell.
There is also the issue of crossing state lines with marijuana. If you are caught transporting or mailing marijuana across state lines, you may face federal criminal charges depending on the amount. - Give marijuana to someone under the age of 21.
- Cross-state lines or send marijuana through the mail

Is Possession Of Marijuana Still A Crime?
Don’t forget that on the federal level it is still illegal to possess any amount of weed. Although some states allow residents to possess and or grow marijuana, State laws have their limits, meaning they won’t protect you in some circumstances. For example, if you are found in possession of any amount of weed on the grounds of any school or at an airport you will get arrested and face federal charges.
I must warn you that some states don’t play around when it comes to marijuana possession if you are in the following states be extra careful.
In Texas, a simple possession charge may carry a six-month jail sentence and a $2,000 fine. If you are caught distributing or selling weed for money, the penalties may double.
A mandatory five-year sentence with a maximum of 30 years, that’s what you’ll get when you are found cultivating or distributing marijuana in Louisiana. Get this, even if you are caught growing a single marijuana plant, you could get 30 years behind bars and a $50,000 fine.
In Florida, less than an ounce of weed may earn you a $5,000 fine and five years in jail. If you are caught selling within 1,000 feet of a school, park or other specified areas, you may get 15 years in prison and a $10,000 fine.
Concentrates or hash will earn you a 10,000 fine and five years in prison. Less than an ounce of weed can lead to one year in jail and a $2,000 fine.
A single joint can lead to one-year imprisonment and a $5,000 fine.
States that let you smoke weed in peace
If you intend to profit from marijuana, you should move to the following states, why?
The penalties for possession and distribution of marijuana in the following states are lenient meaning if caught, the shit pile you will be in, won’t be as deep as in let’s say Florida.
As long as you are above 21, the law in Alaska allows you to possess, use, gift and transport up to an ounce of weed.
The law allows you to buy and gift up to an ounce of weed to another adult in Colorado.
In Oregon, you are allowed to grow up to four plants at home. You are also allowed to give edibles as gifts.
The possession limit in Nevada is an ounce, you can give it out as a gift or carry it on you and you won’t get in trouble as long as it’s not visible and you don’t smoke it in public.
In Maine, you are allowed to possess up to 2.5 ounces of weed, that’s double what other states allow. Although you are not allowed to sell or buy marijuana in Maine, the law allows you to give or receive marijuana as a gift as long as no money is exchanged.
I’m too chicken to do all that, I want a license
As mentioned above the problem with going legit is it is expensive, but if you have the resources or if you don’t want to screw over the tax man. This is what is required of you:
- Compliance with all safety regulations
- No felony convictions
- Your business must be located outside of 500-1000 feet away from schools, churches and other restricted areas.
- Business plan with an outline of property ownership, costs, business licenses, etc
